Service of Civil Subpoenas on Contra Costa County Sheriff's Office Peace Officers and Civilian Employees (Pursuant to Duties Performed)

CIVIL WITNESS FEE DEPOSIT AND PROCEDURES FOR SERVICE OF PEACE OFFICERS AND CIVILIAN EMPLOYEES OF CONTRA COSTA COUNTY SHERIFF’S OFFICE
(Govt. Code § 68097.1, 68097.2 and § 68096.1)

What is required:

• A $150.00 deposit per employee, per day subpoenaed (Note: This is a deposit only. You may be responsible for the payment of additional funds should the Sheriff’s costs exceed the deposit).
• Copy of the Subpoena

What you get in return:

A stamped receipt stating “Witness Fees Deposited.” Possession of this receipt
is necessary to serve the employee. All work locations will ask to see this receipt.

What you should do after fees have been deposited:

You are responsible for completing service on the employee at his/her assigned
work location. If you are not sure where the employee currently works, contact Sheriff’s Administration at 925-335-1500. If you are unable to personally serve a peace officer, service can be effected by providing two copies of the subpoena to the
peace officer’s immediate supervisor or such supervisor’s designated agent (Government Code § 68097.1).
